SERVICE CONTRACT
This agreement applies to the purchase of services over the Internet. It consists of the rules that determine the terms of hosting between individuals or legal entities and hostider.net. You must read the service agreement in full before ordering any product through our website. The service agreement includes termination, warranty information, responsible parties and rules you must follow. If you do not accept this agreement or any of its terms, please cancel your order. In cases where there is no provision in this contract, T.K.H.K-T. Law of Obligations and T. Commercial Provisions law shall apply.
PARTIES AND SUBJECT MATTER
This usage agreement shall be deemed to have been signed between HOSTIDER INFORMATION SERVICES LIMITED COMPANY (hereinafter referred to as HOSTIDER), which provides the services specified on the hostider.net website, and the legal or natural persons who will receive services from Hostider, with the use of the services offered through the hostider.net website and the services to be purchased with the following articles and conditions. This contract is deemed to be signed in the form of electronic approval, not wet signed, and the parties declare, accept and undertake the accuracy of the information written in this contract. All customers can read the entire agreement on our website, which is open 24/7.
ACCOUNT OPENING
Hostider will check your account after your payment and will activate your account if no fraud is detected. It is your responsibility to provide Hostider with a working e-mail address. In case of a violation of the usage agreement or in case we need to reach the customer, we will communicate with you via this e-mail at account opening. It is your responsibility to use an e-mail account that will always be up to date and open.
In order to update the information that cannot be changed, you need to contact our customer representatives to make the necessary changes. For credit card payments that are not made with 3D Secure, our customer representatives may request identification information in order to ensure identification by the government depending on the credit card used, in this case, the identity must be scanned and sent to us. If you do not fulfill these conditions, your order may be considered fraudulent and may be canceled. The discretion and arbitrariness in this matter belongs to Hostider.
CONTENT PERMISSION
All accounts provided by Hostider can only be used within legal permissions. All customers who utilize our services are deemed to have agreed that all content they publish is lawful and harmless. In addition, customers are responsible for all the content they will publish and Hostider cannot be held responsible for the content published by customers. The customer accepts this in advance. It is strictly forbidden to infringe any copyright or trademark while using our services. This is not limited to unauthorized copying of videos, music, books, photos or any other works. Unauthorized posting of any trademark owner's products will result in immediate termination of your account. Any copyright infringement will result in immediate removal or restricted access to the user account. Repeat infringement on any account will result in suspension of copyright laws or termination of hosting.
RESTRICTIONS
Purchased services are not allowed to be used as backup space, file storage, etc. Sample operations that are not allowed in all our services are as follows,
Communities, IRC Script/Bots, Proxy Scripts, Pirate & Warez software, Photo Scripts, Autosurf/PTC/PPC, IP Scanners, Bruteforce Programs, Mail Bombers/Spam Scripts, Banner/AD Services, File Dump/Mirror Scripts, Auto Streaming, Adult/Pornographic/Erotic/Story/, Lottery and Gambling sites, Muds/RPGs/PPGs/PBBGs, Hacking sites and archives/programs for them, Sites promoting illegal activities, sites for easy profit, Bank bonds and Bank note trading programs, Fraudulent sites, Broadcast or Streaming live sports sites;
Any account holder who connects to a third party network or system without the third party's permission will have their account suspended. In order to access the network or system, you must have a written document of the third party for the transaction directly under your customer control. On Hostider servers, documents are also required from the authorized party to connect to the third party's network or system at its discretion.
Hostider has the right to refuse service to any account holder. Your account may be removed or deactivated from our servers, with or without notice to you, if any material you post is obscene, threatening, propaganda against the state, terrorist, illegal or in any way violates the usage agreement.
When you receive an email from our Abuse department, you are obliged to respond to the notification via the support ticket within 24 hours. Failure to respond within 24 hours will result in suspension or termination of service.

ZERO TOLERANCE RULES
Zero tolerance will be shown for sending spam and similar unsolicited e-mails in bulk. Mail sent from member databases, sending mail to purchased mailing lists is considered spam. The customer account sending spam will be canceled directly without warning.
It is not possible to send spam mail from a server that does not belong to Hostider and host the advertised site on our servers. In the event that the IP address of any account enters the spam blacklists because of the account owner, the account will be suspended or closed immediately.
Hostider reserves the right to modify or close any site, account, database or other component that does not comply with the Terms of Use and to make changes in case of emergency according to its own situation.
Posting content that is potentially harmful to minors, child pornography or any content perceived as such will result in immediate account cancellation and deletion without notice.
Our servers automatically detect the software installed or installed by the account holder to access the information of 3rd parties and automatically suspend the account. In the event that such situations are not automatically detected, the system administrators extract the transactions made by the account holder through the logs and ensure that the account is directly suspended. Accounts are canceled when it is determined that this problem is deliberately done by the account owner.
In the face of DDOS attacks, mail bomber, flood, ip spoffing, etc. that may come to an account, the account is temporarily suspended immediately so that other users on the server are not affected by this situation. Accounts that experience this problem frequently are permanently canceled.
In the event of sudden resource consumption that may affect the server as a whole, and if this happens frequently, the account will be suspended immediately to prevent this from affecting other accounts. Accounts that experience this problem frequently will be canceled. The customer accepts in advance the right of Hostider to regulate this damaging situation.
PAYMENT INFORMATION
All payments are made in advance. Payment cannot be made after using the service, payment is taken before using the service and the service is provided for the price you pay. The date the order is completed and the account is activated is defined as the due date of recurring invoices. If the last payment of the invoice is 3 days overdue, your account will be suspended. However, if 5 days pass after the account suspension, your invoice and service will be permanently canceled.
FEE PAYMENT AND PAYMENT DEADLINES
For all services, customers are obliged to make payments on the due dates. Payments must be made on the due date, there is no flexibility in payments. Services that do not pay by the due date are suspended. Hostider does not give a separate notice in this regard. The existing debt must be paid in order to regain access. In such cases, Hostider officials may create an additional delay invoice for you.
Customers who pay by wire transfer/EFT are required to make a "Payment Notification" via the client panel. In case of late payment dates, Hostider may automatically suspend or permanently delete the account.
Hostider has provided Credit Card shopping opportunity for customers and when the customer makes a purchase with a credit card by the customer; clearly and also customers are informed that their credit card information will be stored and recorded securely and after their approval within the framework of Law No. 6698. If the customer consents to the recording of the credit card by the customer, it is securely recorded in accordance with Law No. 6698.
Due to the service purchase made by the customer whose Credit Card is registered, the customer accepts and undertakes in advance that the invoice for the service fee in the following months will be withdrawn from the relevant credit card without obtaining the customer's approval from this registered credit card when the due date of the invoice is due.
BACKUP AND DATA LOSS
In our products such as Web Hosting, Reseller Hosting, Virtual Server, backups are made daily/weekly to an external backup server. However, backup is provided at an additional cost in services such as Dedicated Server, Mail Hosting. Repeated backups are overwritten over previous backups, backups are kept for only one week. Backup is done automatically by the automation system and is provided as a courtesy service. Hostider is not responsible for your account data for any imaginable reason. Customers are responsible for storing and maintaining their own backups. Hostider cannot be held responsible in case of any possible data loss.
CANCELLATIONS AND REFUNDS
For various reasons, customers can cancel their purchased account by notifying us in writing. For this process, they can come to the service list through the customer panel and send a cancellation request from the product detail. There are two types of cancellation, one of them is immediate cancellation and the other is expiry cancellation. In case of immediate cancellation, the account is closed instantly and the service is canceled. In the case of expiry cancellation, it is a request for the product to be closed when the final payment date arrives. The customer cannot request a refund in any way after the requested cancellation. Hostider cannot be held responsible for any loss and damage that may be imagined regarding erroneous transactions.
Customer accounts hosted on Hostider servers that do not comply with the usage agreement, consume excessive resources and similar reasons may also be canceled. Service cancellations due to specific reasons or an existing reason of Hostider will be refunded through the payment channel made by the customer. Apart from this, the customer cannot request a refund to a different payment channel. Commissions charged by the bank during the refund are deducted from the refund fee.
If our returning customer is a legal entity, they can receive a refund by issuing a return invoice.
10.HOSTING AND RESELLER RESOURCE UTILIZATION
There are resource usage and limitations in the web hosting and reseller hosting products you have purchased from Hostider, these rules are listed as follows;
10.1 Any account opened on behalf of a user on the servers cannot spend more than the package received by the system resources and cannot run for more than 90 seconds. (For example; CGI, PHP Operations, Cron operations)
10.2 Hacking attempts, indexing software, bots that collect content from outside are not allowed to run on the servers.
10.03 Any software related to IRCD cannot be run.
10.04 File sharing software such as Bittorrent cannot be run.
10.05 Any P2P, file sharing activity cannot be allowed.
10.06 Game server activity is not allowed on our servers.
10.07 Cron cannot be run less than 15 minutes.
10.08 Any mysql query cannot run longer than 30 seconds, static files cannot be hosted in mysql databases.
10.09 The maximum inode limit for a user varies according to packages. If this limit is exceeded, the account will be closed. These limits include the entire system such as all uploaded data, e-mail contents included in the account, temporary files opened on behalf of all users, backup files.
10.10 Hostider authorities have the right to suspend the account if resources such as Cpu, Ram, Inode, Line, Traffic are exceeded in the services received by existing customers, or if it damages other accounts on the server.
10.11 In traffic quotas defined as unlimited, usage is limited on the basis of "fair usage". The purpose here is to ensure that users receive service without worrying about traffic quota. Our company reserves the right to intervene in these services if the system load that will occur as a result of traffic usage causes problems in the service received by other users.
10.12 In plans with unlimited disk quota, the usage limit is limited on the basis of "fair usage". Disk quota is defined without quota on the basis of the files that the user will use for the web page. These are basic site files such as html, php, js, css, asp, asp.net. Other than these, it is forbidden to host, store or backup files that are not suitable for the web page. The disk right granted must be used for the purpose of publishing the web page.
10.13 In case of providing unlimited add-on domain service provided on our servers to 3rd parties, their responsibilities and support are entirely their own.
10.14 In all hosting and reseller packages, e-mail sending per account is maximum 100 per hour. If it exceeds the specified number, the service may be suspended without notice.
11.TECHNICAL SUPPORT
Our standard support policy does not include telephone support. This means that support will be provided electronically.
Support transactions are carried out through the support notification (ticket) on our website. Our company cannot be held responsible for support messages sent to us through other channels (e-mail, public sites, instant messaging systems, etc.).
Only the real owner of an account can make a support request for an account. No 3rd party support requests can be submitted or opened through 3rd parties. Opened requests will not be taken into account.
Every transaction sent to the support desk by the account owner is done without question. Therefore, our company cannot be held responsible for the damage caused by users whose system login information is obtained by third parties in any way.
The scope of technical support is limited to the infrastructure service provided. The scope of this infrastructure service is the hardware of the server used, the operating system running on it, the control panel software, the main services connected to it (web server, mail service, ftp service, etc.) and the network access of the server. Technical support of systems such as software and scripts to be installed on the service purchased from our company is outside the scope of our service.
In case of possible insults, slang words, humiliation or untrue accusations against Hostider employees and officials, authorized persons have the right to stop and cancel the service. The account of people who engage in this behavior will be completely closed and will be excluded from the refund.
12.RESELLER (RESELLER) HOSTING CUSTOMER RESPONSIBILITY
You are responsible for providing support to your own customers that you provide commercial service in the reseller hosting service you have received through Hostider. Support will not be provided if your customers you provide service to contact us.
13.VIRTUAL SERVER AND LEASED SERVER RESPONSIBILITY
Hostider reserves the right to reset the password of any virtual server or rental server service it offers. It is the customer's responsibility to keep a valid e-mail address and root password registered in our system. Virtual Servers are backed up by us, but Dedicated Servers are not backed up by us. All data and data backup is the responsibility of the customer. Backup service and responsibility is provided by Hostider at the request of the customer with an additional fee.
14.DOMAIN NAME SERVICE
Hostider is not obliged to prepare the necessary documents and information for the registration process during the domain name sale, this obligation belongs entirely to the customer. It is the Customer's obligation to track and renew the renewal period of the domain name purchased by the Customer. Hostider is not responsible for any domain name that the Customer loses or relinquishes ownership of.
After the customer purchases a domain name, ICANN sends an email for the mandatory "Registrant Verification", it is the customer's responsibility to confirm this email. For unconfirmed emails, the domain name will be suspended and Hostider cannot be held responsible for this situation.
15.E-MAIL USAGE AND SPAM PROCEDURE
The Customer is responsible for any damage caused by harmful content from the content of all e-mails sent and received. Hostider cannot be held responsible for all e-mails sent through Hostider servers, such as spam protection on the counter server receiving the e-mail, not falling into the inbox, unannounced rejection or deletion.
No bulk e-mails can be sent from Hostider servers in any way, if done, the account will be suspended.
The total disk capacity for each e-mail created in all hosting and reseller services cannot exceed 1 GB. In case of exceeding, the user will be notified and the service will be suspended if the exceeding is repeated.
16.BANDWIDTH UTILIZATION
The traffic quota set for accounts is calculated between the beginning and end of each month. Accounts that run out of traffic quota within this period are automatically suspended. In order to reopen the account, the traffic quota must be purchased or upgraded to a higher package. Account holders who do not do this must wait until the start of the following month for their traffic quota to be reset. Traffic quotas not used during the month cannot be carried over to the next month.
17.MONEY BACK GUARANTEE
There is a 7-day money back guarantee for shared services such as Web Hosting, Reseller Hosting purchased. However, there is no refund if the services such as Domain Name, Virtual Server, Dedicated Server, SSL Certificate, Mail Hosting, License Services are active and used.
18.UPTIME GUARANTEE
The Uptime guaranteed for the continuity of our services is 99.9%. This guarantee indicates the rate during the period excluding force majeure, main companies providing internet access, server failures, failures due to customer errors and planned maintenance work. If you fall below this committed rate, you can request a refund for that month.
19.IP ADDRESS DISTRIBUTION, USE AND CHANGE
Hostider has the right to change the IP addresses of all servers at any time. Hostider is not obliged to notify the service customers about the IP address change. Permanent use of the IP address assigned to the customer is not guaranteed. Hostider is obliged to send an e-mail informing the changed IP address to the e-mail address specified in the customer's membership within a maximum of 1 week.
20.PRICE CHANGE
Within the monthly, quarterly, semi-annual and annual period for which customers pay, no price changes will be made before the period expires. Hostider reserves the right to change the prices listed and to regulate the amounts given in the services and this issue will be updated as follows, when the monthly, quarterly, semi-annual and annual period expires, if there is a service purchase with a monthly period, an increase can be made according to market conditions at the rate of CPI announcement of the previous month, if there is a service purchase with an annual period, at the rate of CPI (TUIK Data) of the previous year. The customer accepts this form and rate of increase in advance.
21.DISCOUNT COUPONS
Discount coupons are prepared as a campaign product for those who will receive service from Hostider for the first time. The discount code cannot be used on purchased products or refunds cannot be requested due to the discount coupon. Discount coupons or discounts are only valid for first purchases, and service may be canceled when the account of users who abuse this rule is detected. In addition, campaigns cannot be combined with other accounts and other campaigns.
22. LEGAL INFORMATION
Hostider is obliged to provide any information requested to legal authorities when necessary. This information may include customer information, log records, website address, etc. where necessary.
23.LOSS ABSORPTION
In the services you receive from Hostider, you agree that you will not harm Hostider in any way, you will not cause any material / moral damage and you undertake to compensate for any material / moral damage caused.
24.FERAGAT
Hostider cannot be held responsible for any damage to your business, files and access. Hostider makes no warranties of any kind with respect to the services it provides. This includes data loss, delays, interruptions caused by Hostider and any Hostider employee. Hostider will not accept any responsibility if your data/information is obtained by 3rd parties in case of a hacking incident. However, Hostider undertakes to take all possible security configurations.
25. AUTHORIZED COURTS AND ENFORCEMENT OFFICES
This contract consists of the subject heading "Changes" at the top and the subject heading "Changes" at the bottom and is deemed to have been read and understood by the parties and signed within the electronic approval. Tekirdağ Courts and Execution Offices are authorized to resolve any disputes arising during the implementation of this contract.
26.AMENDMENTS
Hostider reserves the right to make changes to the terms of the contract. Changes made are entered as an announcement in the customer panel on our site for customers with active accounts. Apart from this, changes made via e-mail or any other communication channel are not notified.

We use Admin Data to complete transactions you request, manage your account, improve the Services, and detect and prevent fraud. We may contact you to provide you with billing and important updates about your subscription, including information about new subscriptions, information about security or other technical issues with the Services. We may also communicate with you about third-party inquiries we receive about your use of the Services, as described in your communications. You cannot unsubscribe from these communications. Subject to your communication preferences, we may communicate with you by phone, email regarding other products and services, information, offers or to solicit your feedback.
Payment Data;
We use Payment Data to complete transactions and to detect and prevent fraud. When you provide Payment Data when you are authenticated, we store this data to help you complete future transactions so that you do not have to provide this information again. However, we do not store the security code associated with your payment instrument (e.g. CSV, CVV) in this way.
To remove or change Payment Data, please contact Customer Service. After you close your Account or remove Payment Data, Hostider may retain your Payment Data for as long as necessary to complete your existing transaction and to detect and prevent fraud.
Support Data;
Support Data is information we collect when you submit a support request or run an automated troubleshooter, including hardware, software and other details about the support incident
Communication or authentication information includes chat session personalization, information about the state of the machine and application when errors occur or during diagnosis, system and registry data about software installations and hardware configurations, and error trace files.
Information support can be provided by phone, email or online chat. We may use Remote Access (RA) with your permission to temporarily navigate your machine. Phone conversations with Hostider staff, online chat sessions, Remote Access sessions may be recorded and/or monitored. For Remote Access, we may access the recording after your session. We may terminate your Online Chat or Remote Access session at any time. We use Support Data as described in this privacy statement or additionally to resolve your support incident and for training purposes.
After the support incident, we may send you a survey about your experience and offers. You must opt out of support surveys by contacting support or via email footer, separately from any other communications provided by Hostider.
Some business customers may purchase enhanced support offers (e.g. maintenance agreement). These offers are subject to separate conditions and notifications.
Sharing Information;
We do not disclose Customer Data, Administrator Data, Payment Data or Support Data ("your information") except as described in Hostider's or your agreements or this privacy statement.
We sometimes contract with other organizations to provide services (such as customer support) on our behalf. We may give these organizations access to your information when it is necessary for their business. These organizations are obligated to maintain the confidentiality of your information and are prohibited from using your information for purposes other than those for which they were engaged by Hostider.
We will not disclose Customer Data to a third party unless you instruct us to do so or as required by law. In the event that a third party contacts us to request Customer Data, we will attempt to direct the third party to request such data directly from you. If we are required to disclose Customer Data to a third party, we will use commercially reasonable efforts to provide advance notice of such disclosure unless prohibited by law.
Hostider may share Admin Data or Payment Data with third parties for fraud prevention purposes or to process payment transactions. This sharing is limited to the virtual pos company.
We do not respond directly to data protection and privacy requests from your end users without your prior written consent, unless required by applicable law.
Security Controls and Features
Hostider provides a secure foundation from which customers can design, build and manage their own secure cloud applications and infrastructure.
24-hour monitored physical security; Hostider manages and monitors data centers to protect data and services from unauthorized access and environmental threats.
Permanent zero privilege; Hostider operations and support staff are denied access to customer data by default. When allowed, access is carefully managed and logged in the support application.
Data Location;
Hostider may move the location of customer data within a major geographic region (for example, within the US, Europe or Turkey) for data redundancy or other purposes. Hostider will not move customer data outside of the major geographic regions you specify (for example, from the US to Asia or from Europe to the US), except in the following cases:
Where it is necessary to provide customer support, troubleshoot service problems or comply with legal requirements.
Hostider does not control or restrict the territories in which you or your End Users may access or move Customer Data.
Hostider Account;
In order to access the Services, you or your users may need to sign in with a Hostider account or other authentication mechanism. By logging into one Hostider service, you may automatically be logged into other Hostider services that use those credentials.
Changes to our Privacy Statement
We will occasionally update our privacy statement to reflect customer feedback and changes to our Services. When we post changes to a notice, we will change the "last updated" date at the top of the notice. If there is a major change to the notice or the way Hostider uses your personal information, we will notify you by posting an alert or direct notice before the changes take effect.
